1. Who we are

Clouuud is operated by Ayoub E., based in the United States. Contact: [email protected].

2. Services

We design and build websites for clients under clear USD packages (for example Landing, Business, and Custom scopes published on our site). When we deliver a client website, hosting and related care described in the package or proposal are included as part of that engagement — we are not selling standalone commodity hosting to the general public as a separate product on this site.

Custom work, timelines, and extras are confirmed in writing (email, proposal, or checkout notes) before or during the project. Published package prices are starting points; final scope may adjust price or delivery date by mutual agreement.

3. Accounts and eligibility

You must be able to form a binding contract (generally 18+) and provide accurate contact and billing information. You are responsible for activity under any client login we issue.

4. Payments

Package and project payments are processed through Stripe on our checkout flows or invoices we send. Prices are in US dollars unless stated otherwise. You authorize Stripe and us to charge the payment method you provide for the amounts agreed.

Deposits or full prepayment may be required before work starts. Custom scopes may use milestones. Taxes, if applicable, are additional where required by law.

5. Refunds and cancellations

Because digital design and build work begins promptly after payment, refunds are limited:

• If we have not started work and you cancel promptly, we may refund unused amounts at our discretion.
• Once design or development work has started, fees for completed or in-progress work are generally non-refundable.
• Hosting included with a delivered site is tied to that engagement; early termination does not automatically create a cash refund for unused hosting time unless we agree otherwise in writing.

Chargebacks without first contacting us may result in suspension of services. Email [email protected] to discuss a billing issue.

6. Client responsibilities

• Provide timely feedback, content, brand assets, and access needed to complete the work
• Ensure you have rights to materials you supply (text, images, trademarks, data)
• Use the delivered site and any hosting in a lawful, non-abusive way
• Keep backups of critical content you upload after handoff where applicable

Delays on your side may shift delivery dates without liability to Clouuud.

7. Intellectual property

Your materials. You retain ownership of content and trademarks you provide. You grant us a license to use them solely to perform the project.

Deliverables. After full payment for the agreed scope, you own the final website deliverables created specifically for you (design and custom code produced for your project), subject to third-party licenses (fonts, libraries, stock, plugins) that remain with their owners.

Our tools and portfolio. We retain rights to our pre-existing tools, frameworks, and know-how. Unless you have a written NDA or portfolio opt-out agreement with us, we may show non-confidential screenshots and a short case description of your project in our portfolio and marketing (including clouuud.com).

8. Acceptable use

You may not use our site or services to:

• Break the law, infringe IP, or distribute malware, spam, or phishing
• Host or promote illegal content, child sexual abuse material, or violent extremism
• Attack, scrape abusively, or overload our systems or other users
• Resell hosting or accounts without our written permission

We may suspend or terminate services for violations, with or without notice when needed to protect the platform or comply with law.

9. Third-party services

Checkout uses Stripe. Security and performance may involve Cloudflare. Analytics may use Google Analytics. Domain registrars, email providers, and other tools you connect remain under their own terms. We are not responsible for outages or policy changes of third parties outside our reasonable control.

10. Disclaimers

Except as expressly stated in writing for a paid engagement, the website and services are provided “as is” and “as available.” We do not warrant uninterrupted uptime, that the site will meet every business goal, or that search rankings are guaranteed. Results depend on your offer, content, and market.

11. Limitation of liability

To the fullest extent permitted by law, Clouuud and Ayoub E. are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total liability for any claim related to the site or a project will not exceed the fees you paid us for the specific package or service giving rise to the claim in the twelve (12) months before the claim. Some jurisdictions do not allow certain limitations; in those places, our liability is limited to the maximum extent allowed.

12. Indemnity

You agree to defend and indemnify Clouuud and Ayoub E. against claims arising from content you supply, your unlawful use of the services, or your breach of these Terms.

13. Changes

We may update these Terms by posting a new version on this page with a revised effective date. Material changes to an active paid engagement will be communicated when practical. Continued use of the site after changes constitutes acceptance of the updated Terms for site use; project-specific changes may require mutual written agreement.

14. Governing law

These Terms are governed by the laws of the United States and the state in which Clouuud principally operates its US business, without regard to conflict-of-law rules. Courts in that jurisdiction will have exclusive venue for disputes that cannot be resolved informally, except where applicable law requires otherwise.
